Keamanan Siber Sebagai Bagian Dari Due Process of Law Dalam Penegakan Hukum Pidana

Abstract

Digitalisasi penegakan hukum pidana telah menjadikan data pribadi dan bukti digital sebagai fondasi utama dalam proses penyidikan, penuntutan, dan pemeriksaan di pengadilan. Ponsel, metadata komunikasi, rekaman elektronik, serta basis data perkara kini berfungsi sebagai “bahan bakar” proses pidana modern. Namun, kerangka hukum acara dan praktik penegakan hukum masih kerap memposisikan keamanan siber sebagai urusan administratif atau teknis, bukan sebagai bagian dari jaminan prosedural. Akibatnya, kebocoran, manipulasi, dan penyalahgunaan data berpotensi menggerus hak privasi, merusak integritas pembuktian, melemahkan prinsip fair trial, serta memicu reviktimisasi korban. Artikel ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual, serta ditopang kajian perbandingan dan kebijakan internasional. Artikel ini berargumen bahwa keamanan siber merupakan prasyarat esensial due process of law dalam penegakan hukum pidana berbasis data. Pemenuhan due process tidak cukup dinilai dari legalitas pengumpulan data, tetapi harus mencakup tata kelola keamanan sepanjang siklus hidup data dan bukti digital. Oleh karena itu, artikel ini menawarkan parameter operasional due process digital yang menekankan akuntabilitas, auditabilitas, pembatasan akses, perlindungan korban dan saksi, serta mekanisme pemulihan yang efektif.
