Abstract

Penelitian ini bertujuan untuk menganalisis konsep pemidanaan anak dalam sistem peradilan pidana Indonesia berdasarkan pendekatan penologi yang berfokus pada upaya rehabilitasi dan reintegrasi sosial. Pemidanaan anak memiliki karakteristik khusus karena harus mengedepankan prinsip perlindungan anak dan pendekatan yang lebih humanis dibandingkan pemidanaan orang dewasa. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan, perbandingan, dan konseptual. Hasil penelitian menunjukkan bahwa meskipun sistem peradilan pidana anak di Indonesia telah mengadopsi prinsip rehabilitatif melalui Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak, dalam implementasinya masih terdapat berbagai kendala, seperti kurangnya fasilitas rehabilitasi, minimnya pelatihan bagi aparat penegak hukum, dan rendahnya pemahaman masyarakat tentang pentingnya reintegrasi sosial anak. Penelitian ini merekomendasikan perlunya penguatan kebijakan dan program rehabilitasi anak yang lebih efektif dan berorientasi pada pemulihan sosial.
