Penerapan Prinsip Shared Responsibility Sebagai Upaya Penanggulangan Transnational Terrorism Di Kawasan Asean

Abstract

Penelitian ini dilakukan untuk menjawab permasalahan dalam penelitian ini, yaitu: pertama, bagaimana ketentuan mengenai prinsip shared responsibility di dalam Hukum Internasional; kedua, bagaimana penerapan Prinsip Shared Responsibility sebagai upaya penanggulangan transnational terrorism di kawasan ASEAN. Penelitian ini merupakan penelitian normatif berdasarkan kerangka hukum internasional, sehingga metode yang digunakan adalah metode penelitian normatif. Pendekatan yang digunakan dalam penelitian ini adalah pendekatan undang-undang (statute approach), pendekatan kasus (case approach) dan pendekatan konseptual (conceptual approach). Dari hasil pengamatan, penulis menyimpulkan: pertama, prinsip shared responsibility merupakan sebuah prinsip hukum internasional yang membutuhkan adanya kerjasama antar negara anggota yang didasarkan atas kepahaman masalah bersama, tujuan dan keharusan untuk mencapai tujuan melalui tindakan dan koordinasi antar negara; kedua, Penerapan prinsip shared responsibility dalam penanggulangan terorisme transnasional di kawasan ASEAN mencerminkan pengakuan akan sifat kompleks dan lintas batas dari ancaman ini. Meskipun ASEAN telah membuat kemajuan signifikan dalam mengembangkan kerangka kerja dan mekanisme untuk kerjasama, implementasi efektif masih menghadapi tantangan yang berakar pada perbedaan kapasitas nasional, prinsip non-intervensi, dan sifat yang terus berevolusi dari ancaman terorisme. Ke depannya, keberhasilan penerapan shared responsibility akan bergantung pada kemampuan ASEAN untuk memperkuat mekanisme institusionalnya, meningkatkan kerjasama dengan mitra eksternal, dan mengadopsi pendekatan yang lebih komprehensif terhadap pencegahan dan penanggulangan terorisme. Ini akan memerlukan komitmen politik yang kuat, peningkatan kapasitas bersama, dan fleksibilitas dalam menghadapi ancaman yang terus berubah.
